A power of attorney is a written document in which one person (the principal) appoints another person (the attorney-in- fact) to act as an agent on his/her behalf. In appointing the attorney-in- fact, the principal confers authority to the attorney-in- fact to perform certain acts or functions on behalf of the principal. Powers of attorney can be drafted to be general or limited to special circumstances.

A “durable” power of attorney differs from a traditional power of attorney in that in a durable power of attorney, the agency relationship between the attorney-in- fact and the principal continues beyond the incapacity of the principal. Durable powers of attorney can take effect immediately upon the principal’s execution of the document, or can take effect when a specific event occurs. The latter form of durable power of attorney is known as a “springing” durable power of attorney. The most common purpose served by durable powers of attorney are to handle decisions involving property management or health care, in the event the principal becomes unable to do so himself/herself.
