Driving Under the Influence of Alcohol (commonly called “DUI Alcohol”) is defined under Title 47, Section 11-902 of the Oklahoma statutes as operating a motor vehicle upon a public street or highway with a blood or breath alcohol concentration of 0.08 or greater. A DUI Alcohol becomes an Aggravated DUI when the person has a blood or breath alcohol concentration of 0.15 or greater.

Another common DUI charge is Driving Under the Influence of Drugs (also known as “DUI Drugs”). DUI Drugs is defined under Title 47, Section 11-902 of the Oklahoma statutes as operating a motor vehicle upon a public street or highway with any amount of a Schedule I chemical or controlled substance (defined in Title 63, Section 2-204 of the Oklahoma statutes) in the person’s blood, saliva, or urine.

First offenses for DUI Alcohol and DUI Drugs are misdemeanor charges that carry a punishment range of ten (10) days to one (1) year in county jail and a fine of up to One Thousand Dollars ($1,000.00). A second offense for DUI Alcohol or DUI Drugs is a felony charge punishable by one (1) year to five (5) years in the Oklahoma Department of Corrections and a fine of up to Two Thousand Five Hundred Dollars ($2,500.00). Oklahoma law also requires anyone who is convicted of these crimes to undergo a drug and alcohol assessment to determine whether the person has an alcohol or drug abuse problem. Those convicted of these offenses are normally required to attend a Victim Impact Panel on the dangers and potential consequences of driving under the influence.

When a person is arrested for DUI in Oklahoma, the Oklahoma Department of Public Safety (DPS) initiates an administrative proceeding to revoke or suspend the person’s driver’s license. This is in addition to the criminal case. In order to protect your license from revocation or suspension, you MUST submit a written request for an implied consent hearing to OK DPS not more than fifteen (15) days following your arrest for DUI.
